Adjudicating an Oil and Gas Lease Termination or Cancellation (3100-38)

Description 

Students will learn how to process an oil and gas lease termination or cancellation action for oil and gas leases. Lease terminations occur by operation of law when a lessee does not pay its rental. Lease cancellations occur when a lease is erroneously issued, or a lessee fails to comply with any provisions of the law, or due to judicial proceedings.  After taking this course, students will know how to process lease terminations or cancellations in accordance with H-3108-1, Relinquishments, Terminations, and Cancellations.

Target Audience

Fluid mineral adjudicators or anyone performing their duties including but not limited to Land Law Examiners and Legal Instruments Examiners.

Course Goal

Upon completion of this course, participants will be able to adjudicate an Oil and Gas Lease Termination or Cancellation and send the required notice(s).

Course Objectives

To reach the course goal, students will be given knowledge to:

  • Understand the Rules and Regulations which apply to terminations and cancellations, 
  • Process a lease termination, given an ONRR Termination and Expiration Report, and Serial Register Page (i.e., verify the information in the report matches lease information on file and fill-out draft termination notice (template provided), in accordance with H-3108-1, Relinquishments, Terminations, and Cancellations and MLRS Knowledge Articles).

To receive course credit, enroll in the course on the DOI Talent (DOIT) course page, take the pre-test, follow the KRC directions below, self-certify course completion, and complete the post-test with 70 percent or more.

Directions 

Before starting, it is recommended students print the Terminations and Cancellations - Presentation Slides in 3 Slide Handout format and the exercise materials (found within the Toolbox below). While completing the course it is also recommended students refer to the current version of 3108 Handbook for Relinquishments, Terminations, and Cancellations for sample letters and decisions (see the Reference Docs attachment, in the Toolbox, for a link on where to find).
